When you plan on building a publicly accessible swimming pool in Flanders, it's important the swimming pool complies with the Flemish environmental legislation (Vlarem II).

Even public swimming pools that are privately owned, for instance in a hotel or wellness centre, are subject to this legislation. Only swimming pools that are attached to private homes and not open to the public (whether for free, or for a direct or indirect fee) are exempt from this environmental legislation.

his legislation imposes different standards on jacuzzis, indoor and outdoor pools, paddling pools, immersion pools and therapy pools. Water quality (inspections and treatment systems), construction (materials, ventilation, sanitary) and safety (supervision, first aid, fire safety, storage of chemicals) are all strictly and extensively regulated.

Inspection of public swimming pools

All public swimming pools are required by law to have monthly samples taken by a recognised laboratory. In addition, the water quality must be checked several times daily.

You can expect an unannounced inspection at least twice a year, which is conducted by the Flemish Agency for Care and Health. During this test, the inspectors will check hygiene maintenance, water quality and the overall safety of the pool.

Should the agency come across a violation, the proprietor must immediately take appropriate remedial action. There is even a real risk of the swimming pool (temporarily) being closed down until a safe and healthy water quality can be guaranteed. However, this measure is only enforced to prevent any unnecessary health risks.
